1. Scope and Legal Nature
These Terms and Conditions ("Terms") govern the use of the services offered by Mediterranean Breeze Cruises P.C. ("Company", "we", "us") through its website, online platform, communication channels, or any other medium. By accessing or using our platform or booking a vessel, the client ("User", "Guest", "Charterer") agrees to be bound by these Terms.
The Company acts as the operator and owner of vessels listed and available for rent. It may also act as an intermediary between the User and other owners.
2. Eligibility
Users must be at least 18 years old and legally competent to enter into binding agreements. By using our services, the User warrants that they fulfill these requirements.
3. Bookings and Contracts
A legally binding agreement is formed upon confirmation of a booking request, either online or in writing. Confirmation includes details on the vessel, dates, applicable fees, and any additional services.
Users agree to:
- Provide accurate personal data.
- Adhere to all contractual obligations.
- Comply with applicable maritime laws.
The Company reserves the right to cancel bookings in case of false information or non-compliance with the Terms.
4. Pricing and Payments
All prices are listed in EUR and include applicable taxes unless otherwise stated. Pricing includes the base charter fee. Additional charges may apply, including:
- Fuel (charged upon return based on actual consumption).
- Skipper or crew fees (if applicable).
- Additional equipment or services selected by the User.
A valid payment method is required - Payment is processed securely via authorized payment providers. Failure to complete payment may result in cancellation.
5. Deposits and Security
A security deposit may be requested prior to embarkation. This deposit serves to cover potential damages, losses, or unpaid fees. It may be withheld partially or fully if any issues arise.
Damage charges include but are not limited to:
- Life jacket: €50/unit
- Sun canopy: €100 - €450
- Propeller: €100 - €500
- Anchor: €70 - €130
- Swimming ladder: €190
- Engine leg: €300 - €1000
- Cushion(s) / per piece of equipment: €30 - €180
- Key breakage/loss: €40
All applicable charges must be paid upon return of the vessel.
6. Cancellation Policy
Cancellation terms vary depending on the fare selected and further communication with the Client.
In case of cancellation by the Company (e.g., vessel damage or unavailability), a full refund will be provided or an alternative arrangement proposed.
7. Use of Vessel & Operational Rules
- The vessel must remain within the approved cruising range as indicated by the Company.
- The User is responsible for complying with safety rules and instructions provided by the Captain or Company personnel.
- The vessel is delivered with a full fuel tank and fuel is charged based on actual consumption for each charter.
- Subleasing or commercial use is strictly prohibited.
- Pets, smoking, and participation in racing activities are allowed only with prior written consent.
8. Insurance
All vessels are covered by third-party liability insurance, including damage to third parties, bodily injury, and marine pollution. Passengers' personal property is not insured.
The Company disclaims responsibility for:
- Loss or theft of personal items.
- Damages resulting from misuse or negligence by the User.
9. Captain, Crew & Navigation
- Vessels may be rented with or without skipper, depending on the User's license and applicable regulations.
- The Captain has ultimate authority regarding route changes due to weather or safety considerations.
- Navigation time is recommended not to exceed 8 hours/day.
10. Responsibilities & Indemnity
The User is responsible for any damages caused by themselves or their guests. If the User causes legal claims, arrests, fines, or vessel seizure due to illegal conduct, they shall indemnify the Company fully.
Parents or legal guardians are responsible for children aboard. The Company is not liable for accidents caused by lack of supervision.
11. Force Majeure
The Company is not liable for cancellations, delays, or failures due to unforeseen circumstances (e.g., extreme weather, war, pandemics, natural disasters).
12. User Content & Reviews
Users may post reviews following a completed booking. The Company reserves the right to edit, hide, or remove content deemed offensive or inaccurate.
13. Data Protection
All personal data are processed according to our Privacy Policy and relevant EU legislation (GDPR). Users agree to the storage and handling of their data in the context of booking and communication purposes.
14. Intellectual Property
All content on the platform (texts, logos, photos, software) is owned or licensed by the Company and may not be reused without prior consent.
15. Governing Law & Dispute Resolution
These Terms are governed by Greek Law. Any disputes shall be submitted to the competent courts of Athens, Greece.
